Frequently Asked Questions about Inheritance in Lanzarote (according to Spanish law)

What types of inheritance exist?
  • Testate succession means the deceased has left a valid will stating how their estate should be distributed.
  •  Intestate succession applies when no will exists, so Spanish inheritance law determines who inherits.
  • A will is a legal document in which a person declares how their assets should be distributed after their death.
  • In Spain, there are holographic wills (handwritten, valid but risky) and notarial wills (drawn up before a notary and far more secure).
  • An intestate declaration of heirs must be processed, usually before a notary.
  • Without this step, the inheritance cannot be distributed, and tax penalties may arise.

The estate is divided into three parts:

  • Compulsory share: reserved by law for forced heirs (children, spouse, parents).

  • Improvement share: allows the testator to favour a specific heir among the forced heirs.

  • Free disposal: the testator may leave this portion to anyone.

  • Yes, but only for legally recognised reasons (such as abuse or failure to provide support), and it must be clearly stated in the will.
  • Disinheritance can be challenged in court if not properly justified.

You will need to obtain the death certificate, the certificate from the Central Registry of Wills, a copy of the will (if any) or the declaration of heirs (if there is no will), draw up an inventory of the assets, sign the public deed of acceptance and distribution of the estate, pay the Inheritance Tax, and finally register the property at the Land Registry.

  • You can renounce the inheritance, which must be done before a notary.
  • Alternatively, you may accept the inheritance with the benefit of inventory, meaning you are only liable for debts up to the value of the inherited assets.
  • The Inheritance and Gift Tax must be paid within 6 months from the date of death (an extension of another 6 months may be requested).
  • In the Canary Islands, there is a 99.9% tax allowance for inheritances between parents, children, spouses, siblings, uncles, and nephews/nieces.
  • Not always, but when disputes arise or the estate is complex, legal advice ensures clarity and avoids costly mistakes.
  • In Lanzarote there are specialized law firms that offer comprehensive advice. ABOGADAS LANCELOT is the leading inheritance law firm in Lanzarote.
  • Yes. If you renounce your share, it automatically passes to your children by right of representation, so they must also formally renounce it if you do.
  • If the child is a minor, judicial authorisation will be required for the renunciation to be valid.
